Court Revives Lawsuit After Royal Caribbean Settles With Family

Lawsuit Alleges Negligence, Reckless Conduct by Cruise Line

A federal appeals court has revived a lawsuit against Royal Caribbean Cruises Ltd. brought by the grandfather of an 18-month-old girl who fell to her death from an open window on one of the company's ships.

The grandfather, Salvator Anello, filed the lawsuit after his granddaughter, Chloe Wiegand, died in July 2019 when she fell from an open window on the Freedom of the Seas ship while it was docked in San Juan, Puerto Rico. Anello alleges that Royal Caribbean was negligent and reckless in failing to prevent the toddler's death.

Royal Caribbean settled with Anello and his wife in February 2021 for an undisclosed sum. The lawsuit was dismissed, but the appeals court reinstated it, ruling that the settlement did not bar Anello from pursuing his own claims against the cruise line.
